Terms of Service

By signing up for Spot the Brand, you agree to these terms. If you don't agree, don't use the service.

1. The service

Spot the Brand is a brand monitoring platform that combines computer vision with social content scraping to identify mentions of your brand. We provide dashboards, reports and automated alerts.

2. Account and access

You must be 18+ and have authority to bind your organization.
You are responsible for keeping your login credentials secure.
One subscription covers one brand. Multi-brand groups need Enterprise.
User seats are per active human user. No shared accounts.

3. Subscriptions and payment

Monthly subscriptions billed in advance.
14-day free trial on Starter and Pro plans. No charge if cancelled before trial ends.
Cancellation takes effect at end of current billing period. No prorated refunds.
Prices in EUR exclusive of VAT. VAT added per applicable tax rules.
Failed payments: service paused after 14 days past due; full cancellation after 30 days.

4. Credits

Premium actions (historical backfill, extended scans, manual scrape triggers) consume credits. Your plan includes a monthly credit allowance. Unused credits roll over for 1 month. Extra credits available for purchase.

5. Acceptable use

Monitor only brands you own or have written authorization to represent.
Do not use Spot the Brand to harass, stalk or build profiles of individual creators.
Do not resell data exported from Spot the Brand without our written agreement.
Do not attempt to circumvent rate limits, reverse engineer the service, or scrape Spot the Brand dashboards via automation.

6. Data ownership

You own your brand configuration (product lines, reference images, hashtags, seed list).
Detection results and analytics derived from public content belong to JackandAI but are licensed exclusively to you for the duration of your subscription.
You can export all your data at any time as CSV or JSON.
After cancellation, your data is retained 30 days then permanently deleted unless you request earlier.

7. Service availability

We target 99.5% uptime. Scheduled maintenance announced 48 hours in advance where possible. Pro and Enterprise plans include credit refunds for downtime exceeding the SLA.

8. Third-party services

Spot the Brand relies on Instagram and TikTok as data sources. We are not affiliated with these platforms. Changes to their terms or APIs may affect detection coverage. We commit to communicating any material changes within 7 days.

9. Limitation of liability

Spot the Brand is provided "as is". We do not guarantee detection accuracy, completeness or commercial outcomes. Our maximum liability is limited to the fees paid in the 12 months preceding the claim. Not liable for indirect, consequential or lost-profits damages.

10. Termination

You can cancel any time via the dashboard or by emailing us. We may terminate accounts that violate acceptable use, infringe IP, or are in 30+ days payment default.

11. Confidentiality

Both parties protect each other's confidential information. We never share your customer list, detection data, or strategy with third parties without consent (except as compelled by law).

12. Governing law

These terms are governed by Dutch law. Disputes go to the courts of Amsterdam.

13. Changes

We may update these terms. Material changes are announced by email 30 days before they take effect. Continued use after the effective date constitutes acceptance.
